General Terms and Conditions of Use, Делта Недвижности

1. About us

Делта Недвижности (hereinafter: "we" or "our company") is the operator of the digital real estate platform delta.mk (hereinafter: "the Platform").

2. Acceptance of terms

By accessing, registering, or using the Platform, the user confirms that they have read, understood, and accepted these General Terms of Use (hereinafter: "Terms") in their entirety. If you do not agree with any part of the Terms, please refrain from further use of the Platform.

Делта Недвижности reserves the right to change the Terms at any time. The current version is always available on the Platform. Continuing to use the Platform after the changes take effect constitutes acceptance of the updated version.

3. Description of services

Делта Недвижности is a free digital platform for advertising and searching real estate on the market of the Republic of Macedonia. The Platform serves as a link between real estate agencies and individuals looking for property to purchase or lease.

3.1 For individuals (natural persons)

Registered individuals have access to the following functionalities:

• Searching and viewing real estate listings
• Subscription to personalized notifications for new listings
• Submitting requests for property value assessment
• Receiving personalized offers directly from agencies
• Access to real estate market analysis

3.2 For agencies (legal entities)

Verified agencies have access to the following functionalities:

• Creation and management of an agency profile
• Publishing an unlimited number of real estate listings
• Processing requests for assessments and personalized offers
• Direct communication with potential clients
• Management system for their employees

4. Registration and User Accounts

4.1 Individuals

Any natural person over the age of 18 can create a user profile on the Platform in one of the following ways:

• Registration with email and password
• Registration via Google Sign In

After successful registration, a confirmation message is sent to the user's email address. Email verification is mandatory for full account activation. The verification link is time limited. If it expires, the user can request a new one.

4.2 Agencies

Real estate agencies and legal entities can submit a request to open an agency account. Verification of an agency account is performed via confirmation of the tax identification number (EDB) and is a mandatory prerequisite for publishing listings.

Делта Недвижности reserves the right to reject, suspend, or terminate an agency account if:

• The entered data is incorrect or fraudulent
• There is a reasonable suspicion of misuse or illegal activity
• The agency violates these Terms

4.3 Account Uniqueness

Each user and each agency may maintain only one active account on the Platform. Creating multiple accounts for the same person or legal entity is not allowed.

5. Authentication via Google (Social Login)

The Platform offers the possibility for registration and login via Google Sign In (Google LLC, USA). During this authentication, Google transfers certain basic data to Делта Недвижности, including your name, email address, and unique user identifier, in accordance with your Google profile settings.

This data is used exclusively for identification during login and for managing the user account. For details on how Google processes your data, we refer you to Google's privacy policy.

6. Listing Rules

Only agencies with a verified account have the right to publish listings.

6.1 Accuracy and Legality of Content

The agency commits that:

• All information in the listing is true, accurate, and current
• It only advertises properties for which it has a legal right or mandate (owner, representative, or broker)
• It deactivates listings for properties that are no longer available on the market (sold, rented, withdrawn)
• The listings are in accordance with the positive legal regulations in the R. Macedonia

6.2 Prohibition of Double Listing

Each property may be the subject of only one active listing on the Platform. Parallel publication of identical or substantially similar listings for the same property is prohibited and will result in the removal of the duplicate without prior notice.

6.3 Image Rules

• Images must exclusively display the advertised property
• Downloading images from third party listings is not allowed
• Images must not contain logos or contact information of competing platforms
• Using protected images without appropriate permission from the copyright holder is prohibited

Делта Недвижности reserves the right to remove images that violate the above rules.

6.4 Video Content

Agencies can attach a link to a YouTube video for an additional presentation of the advertised property. Делта Недвижности does not manage YouTube content and bears no responsibility for it. By activating the video, technical data (including IP address) may be transferred to Google LLC in accordance with their privacy policy.

7. Forbidden Content

Without exception, it is forbidden to publish listings or content on the Platform that contain:

• Offensive, hateful, racist, sexist, or discriminatory expressions
• Defamation or content that harms the reputation or rights of third parties
• Advertising for competing listing platforms, auctions, or e commerce
• Offers for illegal, prohibited, or strictly regulated products and services
• Pornographic content or material harmful to minors
• Intentionally false or misleading information for the purpose of fraud
• Content exclusively in a foreign language without a Macedonian translation

Делта Недвижности reserves the right to remove any content that it deems violates these rules or legal regulations, without an obligation for prior notice.

8. Notifications and Communication

8.1 System Notifications

All registered users will receive mandatory system notifications related to their account (security instructions, changes to terms, verification status, etc.). These messages cannot be opted out of as they are an essential part of the service.

8.2 Marketing Notifications

Users who have given express consent can receive marketing notifications via email or push notifications. Consent can be withdrawn at any time:

• Via the "Unsubscribe" link in every marketing message
• Through the user account settings
• By directly contacting deltanedviznosti1@gmail.com

Upon withdrawal of consent, marketing messages will be stopped within 14 days. System notifications will continue to be sent.

8.3 Communication via WhatsApp and Viber

The Platform features buttons for direct contact with agencies via WhatsApp (Meta Platforms Ireland Limited, Ireland) and Viber (Rakuten Viber Luxembourg S.A.). These buttons represent a direct link to external platforms that Делта Недвижности does not manage.

By clicking these buttons on their own initiative, the user consciously accesses external services and accepts that their data (phone number, metadata) will be processed outside of Делта Недвижности, according to the privacy policies of the respective providers.

Делта Недвижности has no access to the content of private conversations exchanged via WhatsApp or Viber.

9. Maps

The Platform displays maps based on OpenStreetMap via the Leaflet library for the purpose of visualizing the location of advertised properties. When displaying maps, your IP address may be transmitted to the servers of the OpenStreetMap Foundation.

If you do not want your IP address to be transmitted, you can disable maps in the Platform settings. Disabling this functionality has no impact on other functions.

10. Personal Data Protection

10.1 What data we collect

During registration and use of the Platform, Делта Недвижности processes:

• First name, last name, or company name
• Email address
• Contact phone number (optional for individuals, mandatory for agencies)
• Tax ID (exclusively for agencies, not displayed publicly)
• IP address
• Technical data about the device and browser

10.2 Purpose and Legal Basis of Processing

Делта Недвижности processes personal data for the following purposes:

• Execution of the contract, enabling registration, authentication, and access to functionalities
• Legal obligation, compliance with personal data protection regulations
• Legitimate interest, improving security and service quality
• Consent, sending marketing notifications (only with your prior consent)

10.3 Data Retention

Personal data is kept only as long as necessary to achieve the purpose for which it was collected. After a user account is deleted, personal data will be archived for no longer than 12 months, after which period it will be permanently deleted, except in the case of a legal obligation for longer retention.

10.4 Data Security

Делта Недвижности applies appropriate technical and organizational measures to protect personal data from unauthorized access, loss, alteration, or disclosure. However, no data transmission system over the internet can guarantee absolute security. If you have knowledge of potential misuse or breach of your data security, please notify us immediately at deltanedviznosti1@gmail.com.

10.5 User Rights

According to the Law on Personal Data Protection, you have the right to:

• Request access to the personal data we keep about you
• Request correction of inaccurate or incomplete data
• Request deletion of your personal data
• Request restriction of processing
• Withdraw marketing consent at any time

11. Cookie Policy

The Platform uses cookies, small text files that are saved on your device, for the purpose of proper functioning and improving the user experience.

You can manage cookies through your web browser settings or through the cookie banner on the Platform. Note that disabling mandatory cookies may affect the functioning of certain parts of the Platform.

12. Responsibility

12.1 Responsibility of Users and Agencies

Users and agencies bear full responsibility for the accuracy, legality, and content of the information they enter and publish on the Platform.

By creating an account and publishing content, the user guarantees that:

• The entered information is true and does not violate the rights of third parties
• They will not misuse the Platform for illegal or harmful purposes

12.2 Limitation of Делта Недвижности's Responsibility

Делта Недвижности is an intermediary platform and is not a party to the transactions or agreements between agencies and users. Делта Недвижности bears no responsibility for:

• The accuracy, completeness, or legality of the content published by the agencies
• The outcome of business transactions between users and agencies
• Temporary unavailability of the Platform due to maintenance or technical problems
• Damages caused by unauthorized use of a user account due to the user's own negligence

13. Account and Password Security

For your security, we advise you:

• To keep your password strictly confidential and not share it with anyone
• Not to reuse the same password on multiple platforms
• To change your password regularly
• To activate two factor authentication if available

Делта Недвижности will not ask for your password via email, phone, or messages. If you receive such a request, treat it as a fraud attempt and notify us immediately at deltanedviznosti1@gmail.com.

14. Age Limit

The Platform is intended exclusively for persons over 18 years of age. Minors do not have the right to create user accounts. By registering, the user confirms and guarantees that they meet these conditions. If we learn that an account has been created by a minor, it will be immediately suspended.

15. Account Suspension and Termination

Делта Недвижности reserves the right, without prior notice, to suspend or permanently terminate the account of a user or agency who:

• Violates the Terms of Use
• Entered false or fraudulent information during registration
• Shows signs of misuse of the Platform
• Acts in a way that harms other users or Делта Недвижности

After suspension or termination, the user loses access to the Platform. Content published through the suspended account may be permanently removed.

16. External Links and Platforms

The Platform may contain redirects to external websites and services (YouTube, WhatsApp, Viber, Google, etc.). Делта Недвижности does not manage these platforms, does not endorse their content, and bears no responsibility for their privacy policies or the way they process personal data.

Accessing external links is your personal choice and happens outside the control of Делта Недвижности.

17. Platform Availability

Делта Недвижности makes efforts for the Platform to be available continuously, however, it does not guarantee full and error free availability. The Platform may be temporarily unavailable due to:

• Planned maintenance and updates
• Technical defects or external attacks
• External factors beyond the control of Делта Недвижности (force majeure, interruption of internet services, etc.)

Делта Недвижности will not bear responsibility for damages caused by temporary unavailability of the Platform.

18. Changes to the Terms

Делта Недвижности reserves the right to update and supplement these Terms at any time. For significant changes, users will be informed via email or through a prominent notice on the Platform, at least 7 days before they take effect. The current version of the Terms is always available on the Platform. Continued use of the Platform after the effective date of the changes constitutes acceptance of the updated Terms.

19. Applicable Law and Competent Court

These Terms are based on and interpreted according to the legislation of the Republic of Macedonia.

For all disputes arising from or in connection with the use of the Platform, the Basic Civil Court in Skopje is competent. Делта Недвижности reserves the right to pursue its claims before any other legally competent court.
